Terms of Service

Smartletter is a SaaS platform to create, AI-generate, schedule and send newsletters to an email audience, collect subscribers, and monetize that audience through a built-in affiliate network.

You must be at least 18 and provide accurate information. You are responsible for keeping your credentials confidential and for all activity on your account.

Sending email through Smartletter is strictly conditioned on the following rules. Any breach may result in immediate suspension of sending, or of the account.

• You only send to recipients who have given explicit opt-in consent to receive your communications.
• You never use purchased, rented, scraped, or third-party lists obtained without consent.
• Every email includes a clear, working unsubscribe link; you honor opt-outs promptly.
• You send no deceptive, fraudulent, unlawful, hateful, or spam content.
• You comply with applicable electronic-communication laws (GDPR, ePrivacy, CAN-SPAM, CASL as relevant).
• You keep bounce and complaint rates low; we enforce an automatic suppression list for hard bounces and complaints.
• You never impersonate a brand, an organization or a person, and for any contact import you confirm that you have the consent of the people concerned.

We reserve the right to monitor reputation metrics and to suspend any sending that risks the deliverability of the platform or its other users.

You are solely responsible for the content you send, the lists you use, your subscribers' consent, and the compliance of your communications with the law. You indemnify Smartletter against any claim arising from your use of the service.

The service is offered on a free plan and paid subscriptions (Starter, Pro), each with its own send, site and AI-credit limits. Payments are processed by Stripe. Subscriptions renew automatically until cancelled. Except where required by law, amounts paid are non-refundable on a pro-rata basis.

Smartletter may offer to place partner offers in your newsletters and to share a portion of the revenue generated. Participation is optional and governed by the specific terms presented in the application.

You retain ownership of your content. You grant us a limited license to host and process it in order to provide the service. The platform, its brand and its code remain the property of THE DUG MEDIA LTD.

You may close your account at any time. We may suspend or terminate an account for breach of these terms, in particular the anti-spam policy, with or without notice depending on severity.

In case of a breach of the acceptable use policy (spam, phishing, impersonation, lists that were purchased, rented or collected without consent), SmartLetter may suspend or terminate the account without notice and without refund, including amounts already paid for the current period. SmartLetter may report the facts to the authorities and to the providers concerned.

The service is provided “as is”. To the extent permitted by law, our liability is limited to the amount paid over the last twelve months and excludes indirect damages. We do not guarantee delivery of every email, which depends on external factors.
